New Court Documents Show MS Knew About 360 Disc Scratching

But You Already Knew That!

Way back in July of 2007, a class action lawsuit was filed against Microsoft. In case you don't remember, the suit alleged that the company knew that the Xbox 360 causes discs played in it to become scratched. It was further claimed that the company's decision to rush the 360 to market, "while positive for Microsoft, was detrimental to consumers because the Xbox 360 suffered from numerous hardware defects." Oh yeah, the lawsuit wants no less than $5 million from MS for damaged hardware, and, I'm guessing, lawyers' fees.

Documents pertaining to the case were unsealed last week, and there are some internal MS memos that could prove a bit of an Achilles' heel for the Redmond based giant. It would appear that Microsoft was aware of the issue, and had in fact come up with three distinct plans to fix it before launching the console. Each solution was fraught with its own specific problem for implementation; one was deemed too expensive, another would slow game load times, and the third would have interfered with the opening/closing mechanism.

Now I'm no legal expert (although I have seen Liar Liar twice) but I can't see how these documents can serve to help Microsoft in any way, shape, or form. The court is still deciding whether or not to even grant the case class action status, so we're a long way from any kind of "trial" or "verdict". Stay tuned though, we'll keep you posted.

    assuming that the case goes to court, and assuming microsoft is ordered to pay out the big bucks in remuneration - who would actually get that money? would every xbox owner be sent a check for whatever ridiculous amount the payoff breaks down to per person?
