Take-Two Sues Chicago Mass Transit Authority

Removal of GTA IV Ads Sparks a Legal Firestorm

by Sean

About two weeks ago, I reported that the Chicago Transit Authority (CTA) pulled an advertising campaign for the controversial Take-Two game Grand Theft Auto IV after a report aired on the Chicago Fox News affiliate. First of all, I would like to point out that, so far, the lack of the ads on the sides of buses doesnt' really seem to have put much of a dent in the sale of GTA IV.

But, according to a story on GamePolitics, Take-Two doesn't care if the move hurt sales or not, as they have decided to sue the CTA over the ads being pulled. Citing a 2003 decision by the U.S. First Circuit Court which states that an advertising campaign cannot be removed due to the personal opinions of employees of a government agency, T2 hopes to recoup at least the $300,000 the CTA campaign cost.

Big-ups to T2 for not allowing what is nothing more than unwarranted censorship to stand without a fight. It should be very interesting to see how the court handles this case, since Miami has also pulled a GTA IV campaign.
